1. Introduction

Welcome to McCourt Photography. By booking our wedding photography services and using our website [yourwebsite.com], you agree to comply with and be bound by the following Terms and Conditions. Please read these Terms and Conditions carefully before using our services.

2. Services

We provide wedding photography services as described in the contract or on our website. The specifics of your service will be agreed upon in a separate written contract before your event, outlining the date, time, location, and any special requests.

3. Booking and Payment

Booking Fee: A non-refundable deposit of 25% is required to secure your booking. The booking is not confirmed until the deposit is received.
Payment Terms: The remaining balance must be paid in full 30 days before the wedding/event date, unless otherwise agreed in writing. Payment can be made via [payment methods].
Late Payments: If the final balance is not paid by the due date, we reserve the right to withhold our services until payment is made.
Cancellation Policy: In the event of cancellation by the client, the deposit is non-refundable. If the cancellation occurs within 30 days of the wedding/event date, 50% of the total fee will be retained as a cancellation fee.

4. Delivery of Photos

Editing: We will edit and provide the agreed number of final images as outlined in your contract. Raw or unedited images will not be provided.
Delivery Time: Edited images will be delivered within 2 weeks after the event. We will deliver the images via an online gallery where they can be downloaded.
Image Usage: You are granted a personal license to use the images for personal, non-commercial purposes. Any commercial use requires written permission from us.

5. Intellectual Property Rights

Photographer’s Rights: All photographs taken by us remain the intellectual property of McCourt Photography. We retain the right to use these images for promotional purposes, including but not limited to our website, social media, and portfolio.
Client’s Rights: You may print, share, and distribute the images for personal use, but you may not sell, alter, or commercially distribute the images without our written consent.
Model Release: By using our services, you grant us permission to use images from your wedding/event for promotional purposes. If you do not wish for your images to be used in this way, please inform us in writing.

6. Limitation of Liability

Service Disruption: In the unlikely event that we are unable to perform the agreed-upon services due to unforeseen circumstances (such as illness, emergency, or equipment failure), our liability is limited to providing a full refund of any payments made.
Image Loss: We take every possible care to safeguard your images, including backing up files. However, in the rare event of data loss or damage, our liability will not exceed the cost of the services provided.
Force Majeure: We are not liable for any delay or failure to fulfill our obligations due to events beyond our reasonable control, such as natural disasters, pandemics, or other unforeseen circumstances.

7. Client Responsibilities

Cooperation: The client agrees to cooperate fully with the photographer to ensure the successful execution of the photography services, including allowing sufficient time for photography sessions and providing necessary access to locations.
Venue Permissions: It is the client’s responsibility to ensure that photography is permitted at the venue(s) and to secure any necessary permissions or permits.
Timeliness: The client is responsible for ensuring that the event runs on schedule to allow for the contracted photography services to be performed.

8. Privacy and Data Protection

We take your privacy seriously. Any personal information provided during the booking process or while using our services will be handled in accordance with our Privacy Policy.

9. Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the updated Terms and Conditions.
